1. Agreement & Information About Us
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "Client"), and Arcos Host, a brand and service operated by Arcos Multimedia ("we", "us", "our").
By ordering, registering for, or using our web hosting packages, managed WordPress plans, domain registration services, or associated hosting products, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Acceptable Use Policy, and our Privacy Policy.
2. Account Registration & Eligibility
To access our services, you must create an account via our secure billing portal (WHMCS Client Area). You warrant that you are at least 18 years old and capable of entering into binding contracts. You agree to provide current, complete, and accurate registration information and to maintain the security of your password and credentials.
You are solely responsible for all activities that occur under your account. You must immediately notify Arcos Host of any unauthorized use or security compromise of your login credentials.
3. 30-Day Money-Back Guarantee
We take pride in our autoscaling cloud architecture. If you are not completely satisfied with your web hosting service, you may request a full refund within thirty (30) days of your initial service activation date.
- The 30-day money-back guarantee applies solely to Cloud Web Hosting and Managed WordPress Hosting packages.
- Non-refundable services include: Domain name registrations and transfers, commercial SSL certificates, dedicated/cloud servers, and custom design or setup fees.
- Free domain names bundled with promotional annual plans will have their standard non-promotional retail registration cost deducted from any refund amount if cancelled within the 30-day window.
- Refund requests must be formally submitted via an authenticated ticket through the Billing Ticket System.
4. Billing, Renewals & Cancellation
Services are billed in advance according to your selected billing cycle (1 Month, 12 Months, 24 Months, or 36 Months). Payments are processed through automated payment gateways (credit card, debit card, or electronic payment processors).
Automatic Renewal: To avoid service disruption, all active hosting plans and domain registrations renew automatically at the conclusion of their billing term unless cancelled prior to the renewal date.
Cancellation: You may cancel your subscription at any time directly through your WHMCS Client Area. Cancellations submitted after the 30-day refund window will remain active through the end of the paid billing cycle without prorated refunds.
5. Cloud Hosting Platform & Resource Fair Use
Arcos Host utilizes an advanced autoscaling cloud infrastructure. Unlike traditional single-server hosting platforms that employ restrictive CloudLinux LVE throttling, our cloud platform dynamically balances traffic across redundant compute and storage clusters.
To ensure optimal stability, security, and performance for all clients across the autoscaling cloud infrastructure:
- CPU & Memory Allocation: Accounts must not generate sustained CPU or system usage exceeding 10% of autoscaling cloud cluster capacity for protracted durations. Sites experiencing sustained viral loads or excessive database queries may be required to optimize code or migrate to dedicated compute instances.
- Storage Quotas: Web disk storage must be utilized strictly for legitimate website files, images, active media, and associated application assets. Using hosting storage as general off-site file storage, unlinked media archives, or mass data backups is prohibited.
- Inactive Mailboxes: Independent email accounts provided with your hosting plan that remain unaccessed and inactive for more than one hundred (100) consecutive days are subject to automated data pruning to preserve mail cluster efficiency.
6. Backups & Data Integrity Responsibility
Arcos Host provides built-in automated backup tools and snapshot restore utilities within your control panel. While we maintain platform-level snapshots for disaster recovery:
You retain ultimate responsibility for maintaining independent, current off-site backup copies of all website content, databases, and critical data.
Arcos Host shall not be held liable for any data loss, corruption, or hardware failure resulting from client configuration mistakes, third-party software updates, or unauthorized account access.
7. Domain Names & Third-Party Registrars
Domain name registrations, renewals, and transfers are conducted in accordance with ICANN regulations and the rules of the applicable top-level domain (TLD) registry.
Arcos Host acts as an intermediary with domain registrar partners. We cannot guarantee that a requested domain name will be available or accepted by the registry. Successful registration grants you the right to use the domain name for the paid term, subject to timely renewals and compliance with trademark and dispute resolution policies.
8. Control Panels & Client Access
Arcos Host offers dual control panel support to serve our entire client base:
- Arcos Cloud Control Panel: The modern, white-label control panel for all current and new cloud hosting accounts, featuring 1-click WordPress staging, PHP version management (PHP 7.0–8.4), free SSL deployment, StackCache, and 10GB mailbox administration.
- Hepsia Control Panel (Legacy): Maintained for existing long-term clients with accounts hosted on our legacy server infrastructure (Hepsia Portal).
9. Technical Support Scope
Arcos Host provides 24/7 technical support covering the server environment, control panel functionality, DNS routing, server connectivity, and core hosting infrastructure.
Our support scope does not include custom code writing, debugging third-party WordPress themes or plugins, or repairing application-level scripting errors created by the client. Assistance for bespoke web design and custom development is available through our parent agency, Arcos Multimedia.
10. Limitation of Liability & Warranty Disclaimer
Except as expressly provided in our Service Level Agreement, our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by applicable law, Arcos Host and Arcos Multimedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or related to the use of our services. Our total aggregate liability under any claim shall not exceed the amount paid by you to Arcos Host for the specific service in the three (3) months preceding the event.
11. Governing Law & Contact
These Terms and Conditions shall be governed by and construed in accordance with applicable state and federal laws, without giving effect to any principles of conflicts of law.
